These Terms and Conditions (“Terms”) govern your use of the Chattoo 1942 website, mobile application, and related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms.

1. Legal Drinking Age and Age Verification
You must be at least 21 years of age to access, use, or make any purchase through this Service. By using the Service, you represent and warrant that you are of legal drinking age in your jurisdiction. We implement age‑verification measures at account registration, checkout, and delivery, and we may deny access or cancel orders if we cannot verify that you are 21 or older.

2. Regulatory Compliance and Role of WineUDesign (NY)
All alcoholic beverages offered through the Service are sold and distributed in New York State exclusively by WineUDesign Corp., a licensed winery/wholesaler located at 156 Engineers Drive, Hicksville, NY 11801. Title to and ownership of all wine products passes from WineUDesign to the purchaser in accordance with New York Alcoholic Beverage Control Law and applicable regulations.[cornell +3]
Chattoo 1942 and Chattoowines.com act as a marketing and ordering interface for products supplied and sold by WineUDesign, and do not themselves hold a license to manufacture or wholesale alcoholic beverages. All sales are subject to New York State Liquor Authority rules and any applicable price schedules and licensing requirements.

3. Prohibited Use; No Encouragement of Excessive Consumption
The Service is intended to provide information about Chattoo 1942 wines, facilitate lawful purchases through WineUDesign, and support responsible enjoyment of wine. It must not be used to promote or encourage excessive, unsafe, or underage consumption of alcohol. We expressly prohibit:
• Content or features that incentivize drinking large quantities of alcohol, binge drinking, or drinking games.
• Use of the Service by individuals under 21 years of age.
We reserve the right to remove content, refuse service, or suspend accounts that violate these standards.

4. Order Placement, Acceptance, and Fulfillment
Orders placed through Chattoowines.com or the mobile app are offers to purchase wine products from WineUDesign. WineUDesign may accept or reject any order at its sole discretion, including for reasons related to regulatory compliance, inventory, delivery area, or age verification concerns.[wineudesign]
No contract for the sale of alcoholic beverages is formed until WineUDesign accepts the order and processes payment. You agree that Chattoo 1942 and Chattoowines.com are not liable for WineUDesign’s decision to accept, decline, or modify an order.

5. Shipping, Delivery, and Geographic Restrictions
Wine shipments will only be made to jurisdictions where direct‑to‑consumer shipment of wine is permitted by law and by WineUDesign’s licensing and shipping policies. An adult 21 years or older with valid government‑issued identification must be present to sign for all deliveries. If age verification cannot be completed or if no eligible adult is present, the carrier may refuse delivery and the order may be returned.
We do not ship to states or jurisdictions where direct shipment of wine is prohibited or restricted, and we may update our list of eligible destinations at any time to remain compliant with applicable laws. It is your responsibility to confirm that receiving wine shipments at your address is lawful.

6. Payment Terms
Payment for orders must be made using the payment methods accepted by WineUDesign. By providing payment information, you represent that you are authorized to use the selected payment method and that all information is accurate and complete. Charges may appear under WineUDesign or another designated merchant of record.

7. Returns, Cancellations, and Refunds
Due to the nature of alcoholic beverages, returns are generally limited to cases of damaged, defective, or incorrect products. Any claim must be submitted within a reasonable time after delivery and may require photos or other proof. 8. Responsible Consumption and Safety
Chattoo 1942 supports responsible enjoyment of wine and does not provide medical, health, or safety advice. You are solely responsible for your decisions regarding drinking alcohol. Never drink and drive, and never consume alcohol if you are pregnant, have medical conditions that prohibit its use, or are taking medications that may interact with alcohol.
We may include educational or informational content about wine, but such content must not be interpreted as encouraging excessive drinking or misuse of alcohol.[apple +3]

9. User Accounts, Data, and Privacy
Your use of the Service may require creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
Our use of personal information is governed by our Privacy Policy, which describes how we collect, use, and protect your data and how you may request access or deletion of your account where required by law and platform policy. Apple requires apps that support account creation to provide account deletion, and our app will comply with this requirement.

10. Intellectual Property
All trademarks, logos, images, text, and other materials on the Service, including “Chattoo 1942” and “Chattoowines.com,” are owned or licensed by Chattoo 1942 or its partners and are protected by applicable intellectual property laws. You may access this content solely for personal, non‑commercial use in connection with the Service, and you may not copy, modify, distribute, or create derivative works without prior written consent.

11. Limitation of Liability and Indemnification
To the fullest extent permitted by law, Chattoo 1942, Chattoowines.com, WineUDesign, and their respective officers, employees, and affiliates shall not be liable for indirect, incidental, special, or consequential damages arising out of or related to your use of the Service, your purchase or consumption of any products, or your reliance on any information provided.
You agree to indemnify and hold harmless Chattoo 1942, WineUDesign, and their affiliates from any claims, damages, or losses resulting from your violation of these Terms, misuse of the Service, or unlawful conduct related to alcohol purchases or consumption.

12. Apple‑Specific Terms (App Store Requirements)
When you access the Service via an iOS application downloaded from the Apple App Store:
• You acknowledge that Apple Inc. is not responsible for the Service, its content, or the sale or delivery of alcoholic beverages.
• Apple has no obligation to provide maintenance, support, or updates for the app; such responsibilities belong to Chattoo 1942.
• Any claims relating to the app, including product liability, regulatory compliance, privacy, or consumer protection issues, must be directed to Chattoo 1942 and not to Apple.
• You agree to use the app only in jurisdictions where purchase and consumption of wine is lawful and where you are at least 21 years old.
The app will not include drinking games, challenges, or other features that encourage excessive or unsafe consumption of alcohol, in accordance with App Store Review Guidelines section 1.4.3 and related provisions.

13. Changes to the Service and to These Terms
We may update, modify, or discontinue features of the Service or revise these Terms at any time to reflect changes in law, platform policies (including Apple’s App Store Review Guidelines), or business practices. Updated Terms will be posted on Chattoowines.com and, where required, in the app. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
14. Governing Law; Severability
These Terms are governed by the laws of the State of New York, without regard to conflict of laws principles. Any dispute arising from or relating to these Terms or your use of the Service shall be resolved in the courts located within New York State unless otherwise required by applicable law.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
